Permanent residency for foreign blue-collar workers: the good, the bad and the political

The Ministry of Labor recently announced a path -- if you can call it that -- for foreign blue-collar workers to gain permanent residency. This has been a long time in the making: the ministry has been talking about this since at least 2015, and lawmakers have been discussing it for at least a year

I initially called the announcement "fantastic news", but honestly, it's only fantastic in that the gate to even begin a journey to permanent residency has been firmly shut to foreign blue-collar workers until now. On ICRT Donovan Smith said the door has been opened just slightly, more as a signal than as an actual practical policy to help such workers gain permanent residency. I'd put it similarly: the new rules provide a gatekeeper who will unlock the gate for a lucky few who can answer his riddles three. 




In other words, the rules are so Byzantine and unachievable that they will apply to approximately zero people. Under the new guidelines, foreign blue collar labor can apply for permanent residency after five years if they have an Associate's degree or some sort of technical or professional certification, along with earning a minimum monthly salary that is about NT$3,000/month above the average for such jobs.

By the end of that, there's an even higher minimum salary requirement (about NT$50,000/month) which approaches what many white-collar workers make in Taiwan -- including foreign white-collar labor. I'm not sure if that requirement is for both pathways.

Even Taiwanese with university degrees might not get entry-level offers much higher than that, so it's deluded to think employers, who recruit foreign labor for blue-collar work through the deeply corrupt brokerage system, are going to do so.

Another option is to work for 6 years in the same industry and be classified as "intermediate skilled workers", which then kicks off a 5-year wait for a total of 11 years. 

Such a salary is unattainable by most blue-collar workers, foreign and Taiwanese alike and creates other hurdles: it's not uncommon to come to Taiwan with a job in, say, fishing, and then switch categories to factory work. Some fields pay better than others, and while all are exploitative toward foreign labor to a degree, some are worse than others (fishing is among the worst, though domestic work, often done by women, is rife with abuse -- including, occasionally, sexual assault.) In other words, some workers change industries to make more money or find work they prefer. Others do so to escape exploitative or abusive situations.

Forcing workers to choose between changing industries and having their time in Taiwan count toward permanent residency is cruel, in a system which is already far too cruel. Not that it matters much, as almost nobody will qualify under the current requirements. 

What's more, it's rather discordant to give foreign blue-collar workers a path to permanent residency -- however impossible actually attaining it may be -- but still not include many them in the Labor Standards Act. That's right -- foreign home care workers are still not covered unless they're from Thailand, because the Thai government requires it. Workers in other industries are, but it's extremely common for employers to simply, well, ignore that.

And before I get into this further, I suggest listening to Donovan Smith and Sean Su on ICRT's Taiwan This Week. They cover the issue nicely, and I will recap what they've pointed out below. 

But first, it's important to point out what foreign workers themselves seem to be saying about this. It comes up about a third of the way through in the 2/18/22 episode, Putting Medigen on the Map. I don't speak Tagalog, Cebuano or any of the Bisayan languages but the commentary is pretty clear in translation. So what are they saying about it?

Many say that the change doesn't mean much until salaries increase so that more people will benefit from or at least qualify for the new pathway. Some say their pay is as low as NT$17,000 a month -- how would they ever reach the minimum threshold? Several say that it would have been a better move to first include domestic/home workers in the Labor Standards Act, an issue which has been strongly campaigned for by migrant worker groups for some time. 

Some call it "useless" -- "just work [in Taiwan], save some money and go home. It's hard to care for old people anyway." One person joked that they hoped to qualify in 20 years. Others straight-up call it "false hope" or "tiring."

"It's like passing through the eye of a needle," one comment read. "You'll still suffer, there are a lot of countries [to work in], just apply to another one." In fact, many pointed out that this is why more workers go to Hong Kong (although foreign workers are just as exploited in Hong Kong, the pay is usually better) or other countries in Asia. 

"Just extend the number of years we can stay, we don't need permanent residency," one person said. Many had something to say about the low salaries on offer in Taiwan.

It goes on like this -- a debate on the same page about including home care workers in the Labor Standards Act got hundreds of replies (with no disagreement I could find). The permanent residency announcements did not even reach 50 comments each, and I struggled to find a single person unequivocally supporting the move. Not everyone on these threads was dismissive of the idea, but almost nobody thought it would be a real possibility for them or actually address the issues they face.

That brings me back to the good, the bad and the political. 

As Donovan pointed out on ICRT, this is how the Taiwanese government operates when it comes to foreigners. They open up the door a sliver, and it's not particularly helpful -- but the door is then open, so the next move is a little easier to make because it's building on something that came before. Eventually, the regulations reach the point where something useful is actually provided to the foreigners in question.

The same thing happened with white collar labor: first it was difficult to even get a visa to teach English in Taiwan. Then, work visas were possible but permanent residency wasn't for all but a select few. Now, permanent residency is fairly easy and the process streamlined, and for certain people it can be gained in just three years instead of the usual five. With dual citizenship, the door remained firmly closed but all for a few aging missionaries. Then it opened a slice, just a few years ago, and helps very few people (though I know someone who obtained citizenship that way). It certainly doesn't help me: the job I would need as an educator in my field to qualify for dual nationality does not meaningfully exist in Taiwan. 

This could be for political reasons: Sean noted that an entire community tried to kick out its Southeast Asian residents. Years ago, I passed a protest on the bus, where people were waving signs saying "foreign labor go home" in Mandarin, and I knew they weren't talking about people like me. In my neighborhood, I had a few confrontations over racist signage that admonished people not to litter in big-font Indonesian, and then an itty bitty Mandarin translation. Of course, my Indonesian neighbors generally don't litter. I'm often up late enough to see who does -- Taiwanese teenagers. 

In other words, there might be opposition from enough voters to matter if these changes happened quickly. Few are likely to notice if it's done slowly. 

It could also be for legislative reasons. I once asked Freddy Lim about immigration -- many of the people who worked on the documentary about him are foreigners living in Taiwan who want dual nationality. He indicated support for the idea, but pointed out that a lot of more conservative legislators don't. So, change comes slowly because if huge steps are taken all at once, a backlash would be far more likely -- however unfair it may be.

My experience as a white professional in Taiwan differs profoundly from a blue-collar Southeast Asian immigrant here. But the legislative mindset seems to follow some of the same slow-moving currents -- although the benefits always come to people like me far earlier, and certainly that's unfair. 

The point is, it's not necessarily wrong to do it this way. There are reasons why it happens. And I understand that the government makes these rules because they think they're doing what's best for Taiwan. I don't agree that they are -- Taiwan benefits from immigration and it knows it -- but that's what they believe. 

However, I tend to think of these things at the human level. 

The result is that such processes take decades. Decades mean a generation or more. That means eventually the rules might change and the gates might open. Eventually the riddles three will become the riddle one, and some time after that that riddle will be fairly easy to answer. But in that canyon of time, one or more generations of immigrants to Taiwan will never be able to benefit from a fairer system. They'll grow old and die, choose to leave or be forced to leave before it can help them.

The turnover is likely much higher for the foreign blue-collar community. They're limited to 12-14 years in Taiwan unless they get permanent residency (still unlikely), switch to a white-collar job (possible for some, but also unlikely) or marry someone who can give them residency (reasonably common). 

By the time the wheels of political change turn far enough to meaningfully help foreign workers, the ones currently here will already be gone. I know it's not common for governments to consider it from that perspective, but perhaps they should. 

And perhaps they should ask the actual foreigners these new rules would affect, and see what they really want. I bet they'll find the answer is better labor conditions, higher salaries, the ability to stay longer (perhaps forever, but perhaps not) and to include home workers in the Labor Standards Act. Perhaps some would want a path to permanent residency too: I don't know, I can't speak for them. But anyone can read the commentary -- it's not hard.

All of those are possible, but they have immediate consequences and will receive immediate backlash from employers and brokers alike. How dare you force us to stop abusing people and apply the law to every worker! If we didn't exploit workers, our business might be somewhat less profitable! Do you think I got this Mercedes Benz by paying workers fairly? 

This would also help Taiwan. Despite the sluggish legislative response to these long-standing issues, they must know foreign blue-collar labor is vital to the country, that other Asian countries offer better pay at the very least, and that the human rights record for treatment of Southeast Asian workers in Taiwan is abysmal, tarnishing Taiwan's reputation as a whole. They must know, as Donovan and Sean pointed out on ICRT, that if they were serious about the New Southbound Policy that these would be the obvious moves to make.

Still -- that is what the Ministry of Labor would do if it actually wanted to help foreign blue collar workers. It would ask them what they need and want, and then...y'know, do that.

Not being racist is free, but some companies still insist on skirting the law

 



Update: very soon after the original post, Wistron changed their policy and now, they only lock employees in their dorms most of the time, rather than almost all the time! The new notice is above. It's not a big improvement. Do better, Wistron.

Over two weeks ago, the Ministry of Labor announced that companies who restrict the freedom of movement of their employees (such as factory workers in a company dormitory) are in violation of the law, and any such restrictions will be "regarded as a serious matter".

While in theory this applies to all employees, it's common knowledge in Taiwan that the dormitory residents are almost entirely (if not entirely) foreign workers from Southeast Asia, and their rights are the ones being restricted. In fact, the MOL pointed out that this is also specifically a violation of laws pertaining to hiring foreign workers, and that the company could see its permit to employ such workers, and the quota they are able to employ revoked. The UDN article above also mentions possible prison terms.

That doesn't seem to have stopped some companies, however. I knew something was amiss when I heard that some workers were being allowed out for just 45 minutes a day.  This is despite Miaoli County (the worst offender, but not the only one) being "reminded" by the central government to follow the law, and the county government subsequently ending the restrictions on foreign workers' movements. 

The government never said anything about 45 minutes a day that I could find, but it turns out these are restrictions coming from the companies. Other than a tweet from a friend that this was the news going around, I couldn't prove it until now, however. 

It seems Wistron -- a company I have worked with before, so I hope a few of my former contacts are reading this -- is one such company, restricting dormitory residents to leaving the dorms in at least one location for no longer than 60 minutes a day. You can read the notice yourself up above. It's dated July 13, so well after they would have received notification that they cannot restrict workers' freedom of movement.

Upon hearing that it was illegal to lock foreign workers in dormitories, apparently some companies are trying to skirt the law by allowing them to leave in very restricted time frames. I suspect this might still be illegal, as according to UDN the law requires "freedom of movement" and treating all workers the same regardless of nationality (which would also imply that it's illegal to restrict workers residing in dorms over ones who have their own accommodation). As most if not all dorm residents are foreign workers, it amounts to treating foreign workers differently, and still is a restriction on "freedom of movement", just a less harsh one. 

There's a good legal case to be made here that these companies are still acting illegally, and should be held accountable. (I am not a lawyer, but it certainly does seem like there's something here to go on). 

At the very least, companies like Wistron are violating the spirit of the law, if not the letter of it, and I must hope that that's not enough of a loophole to keep them out of trouble. 

It's still frustrating that there isn't much the rest of us can do about this. BREAKING NEWS: Racism Still Racist


Except it's not just Miaoli, is it?


Now with updates! Don't worry, the updates are still about how racism is racist.

Yesterday, news broke that Miaoli County was ending the forced containment of blue-collar migrant workers (quoted at length because Focus Taiwan makes their archives inaccessible after a few months):

A controversial stay-at-home order imposed by the Miaoli County government on migrant workers earlier this month will end Tuesday, as the number of new COVID-19 cases recorded among the group has fallen.

In a statement, the county government said that while some migrant workers continue to test positive for the disease in Miaoli, they have all been in quarantine because they were contacts of previously confirmed patients....

The Miaoli County government banned migrant workers from going outside, with the exception of traveling to and from work, on June 7....On June 10, the order was partially relaxed to allow migrant social welfare workers, such as caregivers and domestic helpers who usually live with their employers, to go out when necessary, such as buying basic necessities.


I refuse to call it a "stay at home order" as Focus Taiwan does. Honestly, these were closer to internment camp conditions as the dormitories where many factory workers live are overcrowded, poorly ventilated and frankly, perfect sites for fast viral spread.

it's unclear that the order was indeed fully rescinded. Some reports indicate that it was merely relaxed:




Focus Taiwan: if this is indeed the case, your reporting leaves something to be desired.

Before you say "but I only go out for 45 minutes a day!" or whatever, remember that nobody is forcing you to do that. Besides, you almost certainly live in better conditions than most foreign blue-collar workers. You probably don't live in a cramped hellhole where 6 people share a room meant for perhaps 2.

Despite human rights groups rightly calling the order discriminatory (or in my words, racist), Miaoli County Magistrate and Racist Clown said...well, here's the quote:

In response to the criticism, Miaoli Magistrate Hsu Yao-chang (徐耀昌) said the county government was forced to issue the order to curb the spread of COVID-19 in migrant worker clusters and to prevent a transmission of the virus in communities.

"If new cases, more deaths are reported, how can human rights protection be possible?" Hsu argued at the time.


In other words, he refused to admit that the racist thing he did was racist. And it was racist, as the people forced to stay in their accommodations were decided based on national origin (that is, they are not Taiwanese), and Taiwanese coworkers of the affected groups were not subject to the same order. Foriegn white-collar workers in Miaoli were not subject to the order, or we'd be hearing about cram school teachers in Nanzhuang forced to stay in their apartments.

The forced internment of these workers was not due to contact history with infected individuals, and the Miaoli county government was not "forced" do to anything. It chose to be racist. 

But of course, Hsu will never admit that. And sadly, he doesn't have to: foreign workers can't vote, and Taiwanese voters most likely don't see this as a critical issue. Certainly there has not been strong agitation for change despite being aware of how badly most Southeast Asian immigrants are treated, and some even (wrongly) defend such practices. Nobody in Miaoli is going to lose their elected office over this, even though arguably most of them should. 

Obviously, trying to avoid accountability for such actions is a global phenomenon: I could imagine a political suit from just about any country refusing to own up to their own racism (some, including several former US presidents, build entire brands on it). 

What I'm curious about is this: 

When questioned by reporters, Central Epidemic Command Center (CECC) officials said on June 9 that it had "reminded" Miaoli authorities that it could only enforce orders that were in line with the national Level 3 COVID-19 alert.

The CECC did not revoke the order, however, as it had done previously with other local government policies it had not authorized.


I freely admit that I haven't paid much attention to which local government policies the CECC has revoked. (Update: here's one example of where they did just that).

This implies they always had the power to just shut the Miaoli government's racism down, yet chose not to. The Tsai government, sadly, has a track record just as abhorrent as previous administrations on human rights for blue-collar immigrants: a weak spot in an administration that is competent in most other ways. There's a chance they simply don't care enough, or did political calculations on what this would cost them and made a choice. There are a lot of questions there that I simply can't answer (but feel free to leave observations in the comments). 

There are some bright spots, however. The international media, which until recently tended to ignore Taiwanese domestic issues or presented them only in the light of "China tensions" somehow mysteriously being enrisen-ified, took up this issue across several media outlets (including Channel News Asia, which is usually more of a concern troll regarding Taiwan than actual reliable news). 

Locally, there's been some movement too. Not just on the part of human rights groups either. To vent my own rage, every few days I go into Hsu's Facebook page and call him a racist, because he is one (this has zero effect but makes me feel better). Generally, even though sometimes I get lazy and post in English -- I think enough Taiwanese know the word "racist" that it probably doesn't matter -- there are often locals doing the same thing. This issue does seem to have brought more attention to the overall issue of foreign worker treatment in Taiwan.

It's hard to say what happened. I find it hard to believe that the Miaoli government decided to be slightly less racist (without apologizing at all) because it was making Taiwan look bad internationally. International media attention does tend to have an effect nationally, so it's possible that the CECC's public "reminder" came with stronger behind-the-scenes recriminations. But would the KMT-led county government really care what the DPP-led national government had to say? Did getting slammed by human rights groups make a difference? Probably not: this is the KMT, it's not like they care about human rights! 

More likely -- and I am wildly speculating here -- the national KMT apparatus realized it was getting dunked on an international scale, called up their Miaoli people and told them to quit it. 

That possibility carries a lot of implications. Generally, I've concluded that international media exposure is a one way to get the national government to stop dicking around. Overall, while it's good for critical domestic issues to receive international attention for this reason, I find it wise to try to promote a positive image for Taiwan internationally. I have less confidence that it has an effect at more local levels. However, if the international media can (potentially) help create change by getting one of the major parties to rein in their own? Well, that matters.

Racist treatment of foreign blue-collar workers in Taiwan continues



A week ago, I was mentally preparing to draft a positive post about Taiwan's handling of the current outbreak. The main thesis? That the government had made mistakes, but coverage of those mistakes was devolving into taking potshots: people are frustrated, anxious, possibly out of work (our income has decreased, but we'll pull through) and it's leading to them kicking at Taiwan to a point I felt was unfair.

The shortened quarantine of pilots? A bad move, but few complained about it when there were no outbreaks. The slow vaccine rollout? Come on -- y'all didn't want AZ when it was available, and people like me signed up for self-paid shots because we thought we were saving them from the garbage. That Taiwan is facing Chinese interference and a global vaccine shortage? Not Taiwan's fault. That the government hadn't kept up with evolving data on the emerging variants? Not great, no -- but Taiwan is shut out of the WHO; was this entirely an issue of complacency? The worrying use of data to monitor people in outbreak areas such as Wanhua? Not ideal, but people who don't want to use the QR codes (a level of contact tracing that other countries never even attempted) can still register on pen and paper.

Basically, I was a bit annoyed that, as the rest of the world got an F in its coronavirus response (the US seems to have done a bit of extra credit and might squeak by with a D-), Taiwan was getting kicked because it got an A on the last test but only a B on this one. Like people were ready to turn on an administration that had competently seen us through 16 months of safety -- 16 months made necessary by the fact that (again!) the rest of the world couldn't get its shit together. 

I had intended to say that while some people in the Chinese-speaking public discourse sphere were indeed being constructive and offering ways to do better next time, some were absolutely using this as an opportunity to attack the Tsai administration, CCP-style. Some members of the foreign community were being outright ridiculous in their willingness to buy the bullshit the KMT, CCP and their associated compradores were selling. Although I can't influence local discourse, I was going to state that I would not be a party to this in the foreign community, and that while there are valid criticisms to be leveled at the government, I would not feed the growing toxicity of the discourse in English.

The thing is, I no longer want to write the longer version of that post. I'm angry. 





I can forgive a few mistakes. I can point out where constructive criticism turns toxic. What I cannot forgive is unconscionable racism towards the Southeast Asian immigrant community, which the central government isn't doing enough to combat.


We were all angry when the Miaoli County government forbade foreign blue-collar workers, who are generally from Southeast Asia, from leaving their quarters (most live in cramped factory dormitories or live with the families who employ them as caregivers). We all felt that relaxing restrictions for some foreign workers was completely insufficient.

The move can not be justified on any grounds except discrimination: those workers mix with Taiwanese workers at factories and Taiwanese families in homes, so locking them up while their Taiwanese colleagues and employers are free to move about makes these measures even more cruel and meaningless. The domestic workers are often tasked with running errands which include taking elderly charges out, refilling medication or accompanying them to the doctor. Unable to do this, families would have to do these things themselves -- what purpose did it serve, if other members of the household could still go out?

But now it's not just Miaoli. This is happening in Tainan, in Changhua, and beyond. The central government have handled this issue weakly at best, and have implemented their own restrictions, mostly regarding employee transfers. They have not done nearly enough.



As a result, it hasn't stopped, and with the central government limited in their ability or willingness to shut down the actions of the local governments, I'm not sure how it can be stopped.

I'm not really sure how it is that the government can lay claim to all our data -- including data we weren't asked if we wanted to provide and weren't told was being collected -- but not shut down the completely unacceptable treatment of these workers across the country.

Like a virus, it's spreading. It gets stamped out in one place and breaks out in another. Blame the foreigners. And not just any foreigners, blame the most marginalized foreigners (who happen to also be the majority of foreigners) in the country. If you thought barring foreigners from restaurants and cafes was bad -- and it was -- this is exponentially worse. The former was a form of unfair discrimination. This is outright, blatant, unacceptable and disgusting racism. 

Let me repeat: this is not acceptable. There is no justification. From an epidemic prevention standpoint it doesn't even make sense, because people do not spread diseases on the basis of their national fucking origin. The immigrants who live here interact with Taiwanese and will continue to interact with Taiwanese, because they're still going to work. Forcing them to stay in disease-prone crowded dorms with poor ventilation will only make it worse. 

If you think it is justified, then fuck you.


It's not about race plenty of Taiwanese citizens are from Southeast Asia because they married in and gave up their...no.

 

But COVID is spreading in those communities so it makes sense even though they're still interacting with locals who have freedom of moveme...no.


It is about race, and you know it's about race. 

There's a class element as well, but those factories also have Taiwanese workers who are not locked in, so it is primarily just plain old racism. 

Some companies even try to spin these lockdowns as "helping" the workers, rather than literally jailing them:


                       


In fact, the right move both isn't just to end these racist practices immediately, but to reform the entire blue-collar labor system, top to bottom. It's to proactively prioritize these immigrants on the vaccination list because their living and working conditions increase chances of an outbreak, and to improve those living and working conditions in the long-term. This isn't just for them, but for the country: to prevent further spread, and also ensure the outbreak doesn't shut down vital industries.

What frustrates me -- and why I'm taking it out here -- is that I don't know what to do about it. 

When it was cafes banning foreigners I could contact them privately, and I spent hours doing so, among other actions. Most agreed to change their policy when presented with a reasonable argument and the chance to save face before their businesses got review-bombed. When it's something like trying to wheedle Last Week Tonight into doing an episode about Taiwan, I have a plan for balancing relentlessness with comedy that I hope will work (please sign, by the way). When it's discriminatory Youbike rules, I can write to Taipei City government. 

But this? Yes, we can donate, and should (see the links at the bottom of this post for places where you can do so). We can sign this petition. I suppose I could write to each government to lodge my complaints, but if they're not listening to the CECC, why would they listen to me? So I just don't know what to do except write about it. 

That is incredibly frustrating. I would help occupy the street outside of one of these factories if I thought it would do any good, and if public gatherings were possible. I would write up a letter in Mandarin, if I thought I could influence the discourse, but there are native speakers more eloquent than me with a more local perspective who are better qualified to do this. 

In fact, there is one positive I can think of: there are locals angry about this too. On the social media of politicians promoting these restrictions, the pushback has been local (with a few of us angry foreigners mixed in too). Local friends have been sending me the aforementioned petition so it's getting local attention. Not everyone in Taiwan is as awful as those clowns in Miaoli.

In other words, I feel completely impotent in the face of this issue which angers me so very deeply. It's hard to even write more than a few pieces on it because "Racism Continues To Be Racist" only has so many variations. Your suggestions are welcome.

I re-wrote Focus Taiwan's crap article on foreign blue-collar workers

I'm sorry, but pro-establishment reporting that refuses to question the legality (let alone the humanity) of what the Miaoli government is doing positively enrages me. Other counties, such as Changhua, are considering similar measures and we must put a stop to it before they can do so.

To that end, I've written the absolute flaming garbage heap that Focus Taiwan put out on this issue and included a few ways you can perhaps make a difference at the end.


HUMAN RIGHTS VIOLATIONS/Over 20 foreign blue-collar workers mistreated for violating Miaoli's dehumanizing stay-at-home order

Taipei, June 8 (CNA) Over 20 foreign blue-collar workers in Miaoli have been questioned and had their details taken by police for being outside after the county government violated their human rights by ordering them to remain indoors due to a surge of COVID-19 infections in the county.

Miaoli issued an order one day earlier forbidding foreign blue-collar workers from going outside, with the exception of traveling to and from work, after four electronic companies in the county that employ foreign workers reported cluster infections. Some lawyers have pointed out that such an order is likely unconstitutional.

This is despite the fact that residents of other outbreak centers, such as the one in Wanhua, were not locked in their homes against their will. Such treatment has only been visited on foreign blue-collar workers, who remain one of the most marginalized groups in Taiwan, due to ongoing issues of abuse and mistreatment 

Despite the fact that Taiwan is supposed to be a democratic nation where human rights are respected, the order also states that workers can only travel to and from work using transport arranged by their employers or labor brokers, and that shopping for necessities must be done by a dormitory manager or designated personnel.

As of Tuesday, 21 migrant workers had been mistreated and had their details taken, including age and resident certificate number, for refusing to be treated like animals, Lin Chien-min (林建民), a section chief at Miaoli County Police Bureau's Foreign Affairs Section, told CNA.

The information provided by the questioned workers will be passed on to the county's Labor and Youth Development Department, Lin said. However, it ought to be passed on to a human rights lawyer.

The 21 migrant workers were from Vietnam, Indonesia, the Philippines and Thailand, according to the department.

Rather than re-examining its undemocratic and likely illegal actions, Tu Jung-hui (涂榮輝), deputy department head, said that the employers or brokers of the 21 workers will receive a warning on this occasion, but the department will start issuing fines of between NT$60,000 (US$2,165) and NT$300,000 based on the Employment Service Act to those who repeatedly fail to keep their migrant workers off the streets. The government who issued this order does not appear to be facing any punishment at this time.

"In accordance with the Employment Service Act, it is the responsibility of the employer or broker to give guidance and manage their workers," Tu said. "The workers are foreigners and may not know the regulations, so their brokers or employers are obligated to inform them."

Perhaps the workers in question were simply aware that they were being singled out for human rights violations despite many cluster infections occurring in Taiwanese communities. On this, Tu apparently did not comment.

A Miaoli-based Filipino factory worker, who declined to be named, had mixed feelings about the order because it makes it difficult to buy groceries and food, but had been told that it was also to protect them from the coronavirus. 

Tu said the department is not targeting migrant workers -- even though they very obviously are doing so -- and is asking for everyone to please just accept that the county government gets to act like a tinpot dictatorship unbecoming of a democracy and frankly embarrassing to the nation.

It is unclear whether the inspiration for this rule came from the way the Chinese Communist Party sealed people in their homes against their will, or their treatment of ethnic minorities. 

"We just want migrant workers to stay put for 14 days, because we want to break the chain of transmission. It is a critical period right now, and if after two weeks the situation improves we may ease up on the regulations," Tu said.

There appears to be no similar attempt to ask Taiwanese citizens to stay put for 14 days, so it's unclear why this "critical period" would affect just one group. One likely explanation is racism.

As of Tuesday, over 240 cases, including 196 migrant workers, linked to cluster infections at tech companies in Miaoli have been confirmed, according to the Central Epidemic Command Center. 

Foreign blue-collar employees are considered to be at higher risk of cluster infection because many are forced to live in crowded dormitories provided by companies. 

Humane and thoughtful to stop the spread among this community is to improve their accommodations, including crowdedness and ventilation, and to put them on the vaccine priority list. These options do not seem to have been considered by either the authoritarian Miaoli government, or the national government. This is because of racism.

In addition to foreign blue-collar worker cluster infections in Miaoli, there have also been allegations of these workers being asked to sign a declaration stating they will bear sole legal responsibility and cover treatment expenses if they are infected with COVID-19.

This is as illegal as sealing them in their dormitories.

In response, Taiwan's Ministry of Labor (MOL) said any such document will not exempt employers or brokers from their management responsibilities and fines.

Paul Su (蘇裕國), deputy head of Workforce Development Agency's Cross-Border Workforce Management Division under the MOL, said migrant workers should report to the 1955 Counseling and Protection Hotline for foreign workers if they have been asked by their employers to sign such a declaration.

Although it's difficult for everyday citizens to do something about the autocratic turn of the Miaoli national government, there are several ways to help. The first is to contact your elected representatives. The second is to sign a petition currently circulating to end this discriminatory and illegal practice. Recent immigration reforms in Taiwan are a mixed bag

The cabinet has just approved a new draft amendment that would relax requirements for foreign professionals coming to Taiwan, including those enrolled in postgraduate programs in Taiwan.


As an immigrant myself, it makes sense to be generally in favor of streamlined immigration requirements. But I’m ambivalent about this


On their face, the relaxed rules are fine. I don’t see any good reason to make foreigners wait six months for National Health Insurance coverage if they’re committed to being here for at least a year, and it’s smart to encourage talent cultivated by Taiwan — graduate students at Taiwanese universities — to stay here. 

The enhanced tax incentives, immediate NHI coverage and shortened permanent residency eligibility period apply to “foreign special professionals” — that magic, golden class of foreigners who glitter all the more in comparison to everyone else, who is apparently garbage.

I'm not at all sure that these are the issues that would tip a "special" professional towards coming to Taiwan if they had doubts, with the possible exception of the NHI coverage, as health care is likely a major consideration when making such decisions.


I’m also concerned that these changes target the wrong issues and add yet another layer of elitism to already stratified regulations. While the government has moved quickly on “foreign special professionals”, they neither invest in the foreigners who are already here and committed to Taiwan, nor do they address the horrific human rights abuses and poor working conditions endured by foreign blue-collar workers, most of whom come from Southeast Asia.  


The amendment would also relax requirements for foreign teachers coming to teach subject classes at schools for the children of foreign professionals. Frankly, I do think some  requirements for working in Taiwanese schools can reasonably be relaxed — ask me for examples if you care. However, the lack of specificity in the announcement is jarring: what requirements will change, exactly? The students are children of foreign professionals, who all presumably speak English already, how does this do anything to support the Bilingual by 2030 plan? 


A friend of mine has been having trouble in one such “bilingual school for the children of foreign professionals”, dealing with teachers who create unprofessional materials including a “textbook” that consisted of printed-out Wikipedia pages. Such schools need more professional teaching expertise, not less.


The original draft called for graduates of “Top 500” universities to be allowed to work in Taiwan without the requisite 2 years’ related experience or a Master’s degree. However, that clause was dropped.


That’s a shame, as I supported it. Though I have no idea how “top 500” would be determined (most ranking systems are questionable), it would ensure that prospective immigrants won’t feel they need to teach English to come here. I am in favor of any regulatory change that reduces the non-serious people in my field. If they’re better at doing something else and don’t want to be in a classroom, let them, and leave teaching to people who actively choose it — even if they require training and experience, as I once did. 


So, it’s disappointing that the most promising clause in the amendment was dropped. What’s left is...okay. I’m not against it, but I’m not impressed.


As someone who went through the 5-year wait for her APRC, I have no particular desire to force that on newcomers. And yet from my experience, a five-year wait is an entirely reasonable requirement, especially now that it’s easier to change jobs. I suppose it's a positive change for those with graduate degrees from Taiwanese universities, however: student visas don't count towards the permanent residency clock, but Taiwan would be wise to incentivize such people to stay.

I have no opinion on tax incentives, but it sure feels like offering more benefits to the already-privileged. And everyone should have faster access to NHI, not just Special Magic Wizard Foreigners. 


I can’t help but compare this to the very minor recent improvement to working conditions for foreign blue-collar workers. Starting this month, most of these workers are now being provided with work documents in their native languages as well as Mandarin, rather than Mandarin only. 


That’s great, but frankly, I’m shocked that that wasn’t already the case (and embarrassed that I hadn’t realized it wasn’t)! How did take until the Year of Our Good Lord Baby Jesus in Goddamn Heaven Twenty-Twenty-Fucking-One to make this happen? Seriously?! 


It’s disheartening that the government can move so swiftly to accommodate the already-privileged, but can’t seem to get basic human rights sorted out for the vast majority of immigrants to Taiwan.

You can whine all you want about how it’s the Taiwanese government’s prerogative to “attract” certain “talent”, but the cold fact is that Taiwan needs these workers to keep the economy running way more than they need some tech bro. The fishing, the factory work, the elder care — those jobs are at the solar plexus of Taiwanese society, not whatever Craigstopher McJuggerton from Indiana will be doing here. I will freely admit that what they do is more vital to Taiwan than what I do, as well. 

It's not that I think the Splendiferous Glitter Foreigners shouldn't be welcome in Taiwan. Of course, they should -- but it's already pretty easy for them to come here. The people at risk of indentured servitude or outright slavery perhaps have more pressing concerns.


Finally, it annoys me as a long-termer that the government still seems to be unaware that there are foreign professionals who are already here, who are already committed to Taiwan, and what most of us seem to want is a realistic shot at dual nationality. 


At the risk of sounding like a big baby whinerpants, I’ve recently become aware that the path to dual nationality for someone like me is even more narrow than the existing one. For an educator, the requirement is to become an assistant professor. However, for language teaching professionals, there are essentially no such positions. The very few exceptions I’ve met merely prove the rule. Were I to get a PhD, the most I might reasonably hope to achieve in Taiwanese academia is an annually-renewed “lecturer” contract and very little access to research funding. Even that is rare: most new hires are low-paid adjuncts. The language teachers who are professors are generally Literature or Linguistics specialists who’ve been asked to teach language classes. 


So, it doesn’t matter what I do. I’ll never be a “professor” in the sense that the government requires. That job simply doesn’t meaningfully exist in Taiwan in my field. And yet, that is the requirement to apply for dual nationality. I could “publish in major international journals” (most likely without research funding), but I’ve been too busy training the teachers the government says it wants to cultivate!  


All this despite the government saying repeatedly that it wants to elevate the quality of language teaching in Taiwan, and therefore ostensibly wanting people like me as part of Bilingual by 2030. 


I’m not against these new rules. I wouldn’t even call my ambivalence “jealousy” because I’ve managed to carve out a good life here, get my APRC, and cultivate a career I’m passionate about. Hell, I went to two “Top 500” universities (whatever that means). I have NHI and neither need nor want tax incentives. It is a little depressing to see how pointless it would be to get a PhD for career-related reasons, but that’s a personal issue. 


Rather, the ambivalence stems from annoyance: the relaxed regulations aren’t a bad thing, but they don’t do much to the kinds of immigration reform Taiwan actually needs.

Book Review: Migrante

Many keys have been pounded in the effort to bring attention to the working conditions of foreign blue-collar labor in Taiwan. At this point, I would find it highly suspicious if anyone in Taiwan was not aware of the way these workers are treated: fishermen worked to exhaustion in life-threatening conditions (in some cases even killed by the captains of their ships), wages withheld to the point that they are more enslaved than employed, rampant physical and sexual abuse. Domestic workers forced to work outside their contracts, seven days a week. Factory workers enduring constant safety violations, including dorms which are little more than fire traps


However, if you think that everyone is aware of these horrors, you would be wrong, as this jaw-droppingly obtuse letter to the Taipei Times illustrates. If you need another anecdote, consider my neighbor, who once insisted that the way Southeast Asians are treated in Taiwan is “not racist” because “they come from poor countries so they are more likely to be criminals”. 


Sometimes it takes a novelization — the closest one can often get to being transported into another’s shoes — to really bring home what a deep, black mark this paints on Taiwan’s human rights record. How utterly unacceptable it is, across several industries. 


Enter Joe Henley’s Migrante. Henley himself takes on an aura of Upton Sinclair in the story of Rizal, a fictional man from the Philippines who comes to Taiwan to work on a fishing boat. If the narrative reminds you a bit of The Jungle, that is clearly intentional. If you are asking yourself why working conditions in wealthy, democratic, 21st century Taiwan echo those of American meatpacking factories a century ago before the concept of labor protection was more common...well, yes, that’s a very good question indeed.


In Migrante, the various experiences of foreign blue-collar workers are teased out as Rizal interacts with his fellow fishermen, women who had been abused and raped as caregivers, staff at a cantina in Zhongli, fellow “runaways” at a shelter and finally a factory floor. (Henley addresses both the reasons behind the choice of protagonist, and why a comparatively well-off Westerner in Taiwan wrote Migrante rather than an actual migrante in the preface.)


Although a great deal of fiction weaves social issues into larger narratives, Migrante is more like The Jungle in that narrating social injustice is its main — perhaps only — goal. Don’t let that fool you into thinking it’s simplistic, however. Henley uses Rizal’s experiences to show that the story isn’t as simple as “Taiwanese employers bad”. Yes, the labor broker and boat captain are passively and actively cruel in their respective ways. However, Rizal is eventually offered shelter and a chance to change his job; people do show him genuine kindness. Contrast a Taiwanese government worker’s attempt to help Rizal with the way he’s treated by the Filipino broker in his hometown. Neither cruelty nor kindness know national borders.


Migrante also teases out issues that tend not to be sufficiently examined. For example, as bad as the situation is for blue-collar labor in Taiwan, in many cases the conditions they are trying to escape are as bad, or worse. Toward the end, Rizal starts talking like his employers: keep your head down, don’t complain, you’re lucky to have been offered a job. He knows as he says this that none of it is true, but the way he adopts the language of his abusers is chilling. 


I also noted that throughout much of the story, Rizal was showing classic symptoms of situational depression, an issue that affects every stratum of society but tends not to get much attention in the very poor, as issues of more immediate desperation take precedence. This may be why some people think of depression as a problem affecting the comparatively wealthy. Of course that’s not the case. It’s helpful, then, to see it portrayed here. 


I can only imagine that all of these details came out of the extensive research Henley did in order to write this book, including interviews with the workers whose experiences he is drawing upon. Oft-ignored issues like these are far more likely to be brought up when one actually talks to members of a community in order to tell a well-informed story.


If I have any criticism of Migrante at all, it’s that in some places the prose is laid on a bit thick. It mirrors The Jungle in this way, as well. It doesn’t do this in every way, however. There are clear differences in the personalities of Rizal and Jurgis Rudkus, and Migrante does not end with a discordant “happier ending” of an orator proclaiming that socialism is coming and will save us all. This is to the novel’s credit: Henley doesn’t treat us like dumb capitalist puppies who need a good lecturin’, and I appreciate that. 


It would be fantastic if the ignorant letter-writers and racist neighbors in Taiwan read Migrante, although I know they probably won’t. Those of us who are already aware of the situation should step up our agitation for change. Those who unequivocally tout Taiwan as a bastion of human rights are not entirely wrong, but would do well to reflect on areas where drastic improvement is needed. And we should all remember that when we talk about “foreigners in Taiwan”, the vast majority have experiences closer to Rizal’s than to, say, mine. 

Just as Henley did not write Migrante to bash Taiwan, I am not writing this to attack this country. Both of us call Taiwan home, and I assume both of us will continue to do so. There is so much good here, but human rights need to be taken seriously for all workers. Period.

Of course Taiwanese employers should pay foreign worker recruitment fees

I don't have a good photo, but this captures how I feel about the entire slimy brokerage system. 


Over the past few weeks there's been an ongoing feud between the Indonesian government and the Taiwan Ministry of Labor, and I'm going to state without hesitation that Indonesia is almost entirely in the right, and the Taiwanese government is almost entirely in the wrong. 

According to the Taipei Times, as COVID19 recedes in Asia and recruitment of foreign blue-collar workers resumes, the Indonesian government informed Taiwan that Taiwanese employers of foreign workers would be expected to pay 11 types of recruitment fees beginning on January 1st. These include: 

...labor brokerage fees in Indonesia for caregivers, domestic workers and fishers; and the costs of labor contract verification, criminal records certificates, overseas social security premiums and overseas health checks, as well as transportation and accommodation in Indonesia prior to departure, the ministry said.


The Taiwan Ministry of Labor has rejected the request, giving a few reasons. First, that more information is needed on these fees, as it's not clear how much they would amount to, and second, that there's an agreement in place that all changes to foreign worker recruitment must be negotiated bilaterally before they are put in place. 

That sounds reasonable on its face. If there's already an agreement that changes must be bilaterally negotiated, it would make sense to insist on sticking to that. The lack of clarity regarding what the costs actually are would be a reasonable issue to bring up. "Asking for more information" also seems like a sober move. Any government would want to ensure that its citizens are not exploited. 

This is what I would say if I believed that when it came to foreign workers, the Ministry of Labor was acting in good faith. That is, I would have to believe that if the Indonesian government came to the Taiwanese government with a list of issues with the current fee system, that the Ministry of Labor would be amenable to working out a fairer deal for the workers, even if it meant meaningfully dismantling the brokerage system and putting some fees on Taiwanese employers. 

Do you think that that's how it would go? Because I have...doubts. The Taiwanese government promotes its human rights record extensively, at least when it comes to Taiwanese citizens. Yet shows shockingly little interest in protecting the human rights of foreign blue-collar workers residing in Taiwan.

There is a clear power imbalance between relatively wealthy, industrialized Taiwan, where there is a market for overseas labor, and Indonesia, where that labor might be recruited. There is also a massive power imbalance between employers -- families desiring foreign home care employees, factory owners and companies, and fishing concerns -- all of whom have more resources than the workers they are looking to hire. 

When talking about unknown costs that might impact employers, it's crucial to remember that the system is already exploitative towards Indonesian workers. They often end up in debt before they even leave Indonesia, as a lot of these costs are foisted on them: 

Migrant workers and workers’ rights groups have long complained about having to fully bear pre-employment costs. The problem lies in the current hiring system, which allows brokers to charge migrant workers exorbitant fees that usually take years to repay and require loans even before the workers depart for Taiwan, the groups said.


I find it hard to believe that the people recruited know the costs involved before they sign up; if they're not clear to the government, how are they clear to the individuals recruited? And yet, they're expected to pay. Although much of this happens to workers residing in Taiwan, the Ministry of Labor has seemed fine with it so far.

If the government truly cared that the costs were unclear, then they would have done something about it by now rather than letting brokerage firms saddle those least able to pay with the burden.

In fact, the Taiwanese government does not have a good track record at all when it comes to the treatment of foreign blue-collar labor. Foreign domestic workers (who make up more than half of the workers in question) have fewer protections as they are not covered by the Labor Standards Act, and abuse is rampant. Slavery -- as in, you are going to work for me and I am not going to pay you, and if you disobey I will beat you -- is frighteningly common on Taiwanese fishing boats, to the point that I've mostly given up eating seafood in Taiwan. Rather than dealing with this, the government has been planning to exempt fishing workers from mandated overtime and work hour limits, in effect legalizing the exploitation. Foreign factory worker abuses are routinely uncovered. The brokerage system piles many more fees on top of this process, all of which fall on the heads of people who are already poorly paid. It gets worse. From the original Taipei Times article: 

In addition, the brokers usually side with employers to exploit migrant workers, forcing them to perform jobs that are not in their contract, migrant workers’ rights advocates have said.

 

That's not even the worst of it. They also make it harder, not easier, for abused workers to get help when they need it. In what I believe is the same case linked above, it was clear that the brokerage agency first told the worker "not to get pregnant" rather than help her deal with being raped. In a recent case, an alleged sexual assailant of a newly-arrived Indonesian worker was a broker himself. In another, it was a town councilor

The Ministry of Labor is surely aware of this. It's been extensively reported on, as shown by the links above, yet it continues. When their first priority is making sure that well-resourced Taiwanese (including families that can afford to hire a domestic worker) get the best possible deal regardless of how it impacts the foreigners who take these jobs, do you trust them to negotiate fairly with the Indonesian government to fix one small part of the system -- the fees?

Me neither.  

Once here, workers are routinely subject to discrimination and outright racism. One small example (and not even of the worst kind) popped up in my own community, where someone posted signs in large Bahasa Indonesia script admonishing people not to litter, with a much smaller Chinese translation below. The Indonesians in the neighborhood aren't the litterers, though -- it's mostly local teenagers who take over the community picnic tables after dark, and the occasional thoughtless grandpa. 

Every time people like me (that is, foreign professionals, often from wealthy Western countries) complain about some way in which the government doesn't factor our existence into their policies, we must remember that foreign blue-collar workers face the same issues, with far worse on top of that. 

Any government would want to ensure that its citizens are not exploited, and the Indonesian government is trying to do just that. They are quite smart to see that the Taiwan Ministry of Labor is never going to make it easy to give these workers a fair deal. It makes sense, looking at that power imbalance, and the way such workers are already treated, that they would unilaterally insist on a change. 

The brokerage system simply needs to be abolished; it offers little or no value. I know some Taiwanese employers prefer using it, but they would still be able to recruit workers without it, with far less inconvenience than the workers currently going through it face. 

Most of the other fees should always have been paid by the employers. Flights, contract verification fees, health and criminal checks? If your labor is desired so much that an employer in a foreign country is willing to go to the effort to recruit you, then they need to pay such fees, period. That would be true even if they weren't then offering low wages to the workers. Frankly, any school who wants to hire foreign teachers should also be paying for all of this, and the only reason to complain less about it is that (mostly unqualified) English teachers hired to work in buxibans generally have more access to resources than foreign blue-collar workers, and a better solution would be to cultivate more Taiwanese talent for English teaching jobs. That doesn't make it right, though.

The only good point that the Ministry of Labor has is that clarification of the fees is needed. Despite the concern being raised by Taiwan Report, it's highly unlikely that any worker would -- or would be able to -- spend exorbitant sums on pre-travel expenses in Indonesia, but forcing clarification on brokerage fees would shine a light on a slimy, diseased system and just might disinfect it a little. 

Of course, that would make the brokerage firms unhappy as they thrive, like bacteria, on that lack of clarity. It makes exploitation possible. And the Ministry of Labor is clearly more interested in allowing the brokerage system to continue and lowering costs for Taiwanese employers rather than ensuring that all residents of Taiwan, including foreign workers on its soil, are treated fairly. 

And, again, if they actually cared about clarifying the fees, they would have done so back when the country's most vulnerable residents were forced to go into indentured servitude to pay them.

Instead,  the government is allowing recruitment from other countries to cover the expected dearth in employees from Indonesia. There seems to be little interest in fixing the same system that exploits Indonesian workers, which will then presumably be able to shift its infected focus on workers from other countries. 

No worker should be pushed into a pay-to-play system: there shouldn't be fees required when taking a job. If Taiwanese employers want foreign workers enough to go to the trouble of recruiting them, they should be able and willing to pay for that, period, not foist associated costs onto the very people they are hiring.

The Taichung City government is discriminating against foreign residents for no good reason

It's time to complain again. I hate this as much as you do.


It was announced recently that the Taichung City government would be ending its program offering free public transportation for the first 10km of any ride to all passengers. Starting January 1st, the free transit is only available to some "Taichung residents". Of course, that doesn't mean all Taichung residents, only Taichung residents who are Taiwanese. 

Foreign residents of Taichung are out of luck. 

I'm not a Taichung resident, but if you are, you absolutely should complain. Here's a link to do exactly that. Pass it on. 


The policy will still include foreign spouses and students studying in Taichung, but foreigners without a local spouse will have to pay. 

Let's leave aside that Taichung public transportation is a bit of a joke (it's hard to get anywhere in a reasonable amount of time and every time I go I'm stuck taking taxis everywhere as I don't drive in cities). This is a shame, as good transit makes good cities for residents and visitors alike. The benefits are innumerable and undeniable. I'll be interested to see if the new MRT line improves the situation. 

Let's focus instead on the biggest impact: foreign blue-collar workers, typically factory workers and caregivers/home health aides. 

For "us" (relatively comfortable members of the foreign community who aren't going to hurt from having to pay a small amount for public transit), the insult is more symbolic. For me, it's entirely symbolic: I don't live in Taichung so I'd have to pay regardless, and I'm fine with that. 

For foreign residents who are routinely underpaid, work long hours and are more likely to rely on public transportation on a tight budget, the difference between being able to use the system for free like any other Taichung resident and being asked to pay is likely to exacerbate real struggles. 

As with every city in Taiwan, Taichung needs these workers. They are part of the backbone of a city's workforce. Here in Taipei, I don't know how my local community, full of senior citizens, would function without the large number of caregivers. Taichung's industrial centers surely need them as well. They are residents too, and it's offensive to treat them as outsiders, asking them pay for a service that's free for other residents, all while paying them below-average wages. 

Most visitors will bring or rent their own transportation, or use taxis like me. That means the vast majority of people asked to pay will still be Taichung residents -- just not Taiwanese ones. 

It's not a bad idea to charge for public transit, but it is deeply unfair to ask only some residents to pay, especially when so many of those residents struggle more than their Taiwanese neighbors.

Even though for us privileged foreigners, the issue is the principle and not the actual money involved, it's still offensive. We've been through this before -- again, again, and again. At this point, it's clear that forgetting that foreigners reside in Taiwan too, and we depend on the services that our taxes help pay for too, is either deliberate or deliberately obtuse.

In short, I am extremely tired of the whole "we forgot you guys existed!" game. It's getting old and it's got to stop. Especially when you don't know when the exclusion is deliberate and when your communities are just...forgotten. 

Plus, it reeks of a localist mindset - the only residents of Taiwan who matter are Taiwanese, apparently - that won't help Taiwan in its efforts to reach out internationally. Taiwan not only needs its local workers, both the blue-collar workers that basically keep Taiwan running and the white-collar ones who at the very least pay taxes and are an integral part of the economy, but we're also a strong source of soft power abroad. Some (like me) are privileged and some are underprivileged (a situation which really must be dealt with), but along with locals, we are all residents and we should all be in this together, and be a force that is good for Taiwan together. If the truth is "Taiwan for Taiwanese only and foreigners are only welcome to a certain extent, for what they can give us, but we'll shortchange them at every opportunity"...well, that's just not good for the country. 

And there's no good reason for it. Why can't Taichung residency be determined by the address on your ARC? Why include students (meaning that you're willing to include people without a local household registration) but not foreigners who've lived here for longer? If it's because "students are usually on a budget", well, blue-collar foreign workers are too because they're so underpaid so that's not an excuse either. I could understand making it free for all residents but charging visitors, but this is just plain discrimination as it's not going to be free for all residents! 

Yet it may be free for some visitors -- if your household registration is in Taichung it won't matter if you live in a different city, you'll get the benefit while plenty of actual Taichung residents won't. This isn't a "help Taichungers" strategy. It's an anti-foreigner one.

In short, Taiwan is never going to reach out to the international community abroad effectively if it can't even reach out to the international community locally. If it still forgets -- or stubbornly insists -- that we don't matter, or we don't exist, or that double-standard treatment for different residents is acceptable, or that some residents are more "real" residents than others.

It's not acceptable. It has to stop.
